Does a proceeding pending before a Labour Court or Tribunal in relation to an industrial dispute lapse on the death of the workman?
The Courts had held that when a workman dies his claim tor reinstatement dies with him and the reference proceeding becomes Incompetent. By amending section 10 in 1982 it is now provided that no proceeding pending before a Labour Court or Tribunal in relation to an Industrial dispute shall lapse merely by reason of the death of any of the parties to the dispute being a workman and such Labour Court or Tribunal shall complete such proceeding and submit its award to the Government.
