What is the procedure for discharging or dismissing a workman who is recognised as a protected workman and who is concerned in a pending dispute?
If an employer wants to discharge a protected workman for a misconduct or even otherwise or to dismiss a protected workman during the pendency of any conciliation, arbitration or adjudication proceeding in respect of a dispute in which the workman is concerned, the employer must make an application to the authority before which the proceeding is pending and obtain its previous written permission to do so. Otherwise the discharge or dismissal will be invalid and inoperative in law.
