What is the procedure which the employer has to follow for certification of standing orders?
The procedure for certification of Standing Orders is as follows:-
(a) The employer has to prepare a draft of the standing orders which he proposes to adopt for his industrial establishment. The draft must make provision for every applicable matter specified in the Schedule appended to the Act. It must be in conformity with the provisions of the Act and,as far as is practicable, also in conformity with the prescribed Model Standing Orders if any.
(b) The employer has then to submit the draft Standing Orders prepared by him to the Certifying Officer for adoption in his industrial establishment, which he has to do within six months from the date on which the Act becomes applicable to his industrial establishment.
(c) After receiving the draft Standing Orders the Certifying Officer has to call and hear the employer and the workmen concerned and decide whether or not any change is necessary in the draft to make it Certifiable under the Act. The Certifying Officer has then to certify the draft standing orders after passing a necessary order.
(d) If the employer is aggrieved by the order of the Certifying Officer, he has to prefer an appeal to the Appellate Authority, for the necessary relief. The order of the Appellate Authority will be final.
