What is the duty of an employer while exercising his right under Section 4(6) to forfeit the gratuity of an employee for the damage or loss caused by him to the property belonging to the employer?
The words to the extent of the damage or loss used in S.4(6) are very important. The determination of the amount of damage or loss caused by the employee should be just and proper. It is a well settled principle that one cannot be a Judge of his own cause. The employer should assess the amount of damage or loss with the help of a competent authority and establish the liability of the employee.
