If the employer, instead of availing of the remedy of appeal under section 17 of the Act, files a writ petition under Article 226/227 of the Constitution of India, is the writ petition maintainable?

The writ petition is not maintainable if by filing it the employer has deliberately chosen to circumvent the provisions of law.
