Will an aggrieved woman employee (victim) be entitled to leave during pendency of the proceedings before the Committees under the Act 14 of 2013 & Rules?
There is no such provision under the Act 14 of 2013 or the Rules. However, a circular No.13026/2/2016-Estt(L) dated 14.7.2016 issued by the Ministry of Personnel, Public Grievances and Pensions Department of Personnel & Training. Government of India states that it is considering to issue instructions for the grant of leave to the aggrieved woman during pendency of inquiry up to a period of three months in addition to the leave which she is otherwise entitled to. The leave so granted to the aggrieved woman shall not be debited against the leave account. This proposal on its acceptance will not have any bearing upon the employment in the private sector till the Act 14 of 2013 and/or the Rules are amended.
