Dismissal for the misconduct of “sleeping on duty” is justified. - The Industrial Disputes Act, 1947

Sleeping on duty by an employee, ad chowkidar, despite strict warnings 2 times for the same misconduct, is a grave and serious misconduct. A chowkidar, found sleeping on duty is always danger to create any problem for the management, causing any irreparable loss. A chowkidar being an incorrigible employee is not trust worthy for the duty as a chowkidar.
