A contractor is under legal obligation to ensure payment over and above the minimum wages if such emoluments are received by permanent employees of the establishment. - The Contract Labour (Regulation and Abolition) Act, 1970

Contract Labour have enforceable right under section 21 of the Contract Labour (Regulation and Abolition) Act, 1970, clamining equal pay for equal work, on the basic of directive principle of equality under Article 14 of the Constitution of India.

Contract labours have enforceable right under Contract Labour (Regulation and Abolition) Act, 1970 and Rules, 1971, by raising a dispute before the concerned Joint/Deputy Labour Commissioner or his nominee which is the appropriate Forum.

Under Rules 25(iv) and(v) of the Contract Labour (Regulation and Abolition) wntral Rules, 1971 ad contractor is obliged to ensure payment of amount over and above the minimum wages if such emoluments are enjoyed by those, working as permanent employees in the establishment.
