Relationship of employer-employee would stand established if no rebuttal of such an averment of the claimant is made by the employer since strict rule of Evidence Act is not applicable in cases under the Employees' Compensation Act, 1923 as mostly in the case of private drivers no employment contract is entered into and salary and allowances are paid in case.
