Termination in case of habitual late coming without inquiry will be illegal. Reinstatement with 25% back- wages granted. - The Industrial Disputes Act, 1947

Termination of services of an employee without conducting departmental inquiry for the conducting departmental enquiry for the charges of misconduct of late-coming and unauthorized absenteeism, is illegal since due to such an action of the Management shows that the delinquent employees has been denied to rebut the charges in formal proceeding, justifying his reinstatement with back-wages.
